Trump Announces Relaxations For H-1B, L-1 Visa Holders

The Donald Trump administration has decided to support the workers who seek to return to the country with an H-1B visa for the same job with the same employer they had before the pandemic.

In a move that could help Indian professionals, the Trump Administration has announced certain exemptions in H-1B and L-1 travel ban. On June 22, President Donald Trump announced visa restrictions, temporarily banning H-1B, H-2B, L-1, and J-1 visas. The move was meant to help local employment and curb immigration. The suspension came into effect on June 24, which was supposed to expire on December 31, 2020. 

The ban prevented hundreds of thousands of foreigners who relied on their visas to work in industries varying from technology and consulting to landscaping and seasonal jobs. 

The concern behind the declaration was the drop in the employment rate. Trump said that the overall unemployment rate in the United States nearly quadrupled between February and May of 2020, delivering some of the most extreme unemployment rates ever recorded by the Bureau of Labor Statistics. 

“American workers compete against foreign nationals for jobs in every sector of our economy, including against millions of aliens who enter the United States to perform temporary work. Temporary workers are often accompanied by their spouses and children, many of whom also compete against American workers,” Trump said

Exemption Criteria

1. The US government has granted relaxations to healthcare professionals and researchers associated with cancer, COVID-19, and other communicable disease research.

2. Relaxations are given to those who have permission from the US Department of Defence or any American government agency. The individual must be conducting research, providing IT support services.

3. The exemption allows applicants seeking to resume an ongoing job in the United States in the same position with the same employer under the same visa classification.

4. Individuals who are technical specialists, senior-level managers, and other employees who can contribute towards the immediate and continued recovery of the US economy.

5. H-1B visa relaxations have been given to critical infrastructure sectors- chemical, communications, dams, defence industrial base, emergency services, energy, financial services, food and agriculture, government facilities, healthcare and public health, information technology, nuclear reactors, transportation, and water systems.

6. H-1B applicants must have a salary that exceeds the prevailing wage rate by at least 15 percent.

7. H-1B applicants with a doctorate or professional degree will be eligible for these relaxations.

The H-1B visa holders will also be allowed to take their dependents, including spouses and children, along with them.

What is an H-1B visa?

The H-1B visa is a non-immigrant visa that allows American companies to employ graduate-level foreign workers with specialist skills that require theoretical or technical knowledge. If you do not have a bachelor's degree or higher, you can show degree equivalence through work experience or other qualifications. Most of the companies depend on it to hire thousands of employees from countries like India and China.

How long is an H-1B visa good for?

The H-1B visa is originally valid for three years and can then be extended for another three years. When H-1B status expires, the H-1B holder must either leave the country, obtain an extension of the visa, or apply for a different status (such as an F-1 student or O-1 “extraordinary ability” worker).

What is the success rate of an H-1B visa?

The USCIS denied a total of 18,607 H-1B non-immigrant visas in the first quarter of the fiscal year 2020. While the approval rate for the quarter was 83.4%, which is lower than the average for the previous fiscal year (84.3%). However, it was marked as a great improvement over the first quarter of the fiscal year 2019 when 25,080 visas were denied.

Can H-1B holders travel to the USA now?

According to the August announcement, certain IT professionals and medical workers are permitted to travel back to America. Trump has made a few exemptions that allowed dependents, including spouses and children, to go along with them.

How long can I stay out of the US on an H-1B visa?

The initial period of validity marked on your H1B visa is the expiration date regardless of how many times you enter or exit the country, or how much time you spent travelling around the world.
